FAQ: What exactly are domain name disputes?

We use the term domain name disputes to mean disputes relating to the fact of someone else’s registration and/or use of an internet domain name. The dispute usually centres on a claim that the domain name registrant has registered / used the domain name in a way which specifically targets the trademark owner in an inappropriate way or which infringes the complainant’s intellectual property rights.

As explained elsewhere on our site, there are a number of domain name dispute arbitration schemes which can be a relatively quick and inexpensive way of solving domain name disputes and which enable recovery of the disputed domain name. Or else you can go to court. Although of course the objective should be to resolve the domain name dispute without having to incur the costs and risks of formal domain dispute arbitration if at all possible.

There are many internet or website disputes where the domain name itself is not particularly relevant. For example, your complaint may relate to say a competitor bidding on your name in Google but the infringer’s domain name may be nothing like yours. This is not a domain name dispute as such.
